Release of Liability
PARTICIPANT RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT
Please read carefully. In consideration of being allowed to participate in any way in the Hoof & Horn Farm a division of ZaPow, Inc. programs, its related events and activities, I, the undersigned, acknowledge, appreciate, and agree that:
A. The risk of injury from the activities involved in this program is significant, including the potential for permanent paralysis and death, and while particular skills, equipment, and personal discipline may reduce the risk, the risk of serious injury does exist; and,
B. I KNOWINGLY AND VOLUNTARILY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF EMPLOYEE, AGENT, OR REPRESENTATIVE OF
COMPANY, and assume full and complete responsibility for my participation.
C. I willingly agree to comply with the stated and customary terms and conditions for participation in the programs. If, however, I observe any unusual or significant hazard during my presence or participation, I will remove myself from participation and bring such matter to the attention of a representative of the Company immediately.
D. I, for myself and on behalf of my heirs, assign, personal representatives and next of kin, HEREBY RELEASE AND FOREVER DISCHARGE COMPANY and its or their officers, officials, members, agents, and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and, if applicable, owners and lessors of the premises used for the activity or where the Programs take place(“Releasees”) from any and all claims or causes of action, WITH RESPECT TO OR ARISING FROM (a) ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property associated with or arising from my presence or participation in any of the Programs, WHETHER OR NOT INVOLVING THE NEGLIGENCE OR MISCONDUCT of a releasee to the fullest extent permitted by law, and (b) any illness or physical infirmity arising from my exposure to any virus or disease including COVID19.
I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT AND I FULLY UNDERSTAND ITS TERMS AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
E. I further irrevocably consent to and authorize the Company to use and reproduce any and all photographs and videos taken of me, or any minor or person for whom I am the guardian that accompany me for any purpose whatsoever, without further compensation to me. All such photographs and videos, including negatives and the like, are solely the property of the Company.
FOR PARENTS/GUARDIANS OF PARTICIPANTS OF MINORITY AGE (UNDER AGE OF 18 AT TIME OF REGISTRATION)
This is to certify that I, as legal parent/guardian with legal responsibility for this participant, do consent and agree to his/her release as provided above of all the Releases, and, for myself, my child and our heirs, assigns, and next of kin, I release and agree to indemnify and hold harmless the Releases from any and all liabilities incident to my minor child’s involvement or participation in these programs as provided above, EVEN IF ARISING FORM THE NEGLIGENCE OF THE RELEASEES, to the fullest extent permitted by law.
I hereby grant Hoof and Horn Art Farm & Lauren Watterson permission to use my likeness in a photograph, video, or other digital media (“photo”) in any and all of its publications, including web-based publications, without payment or other consideration.
I understand and agree that all photos will become the property of the Hoof and Horn Art Farm & Lauren Watterson and will not be returned.
I hereby irrevocably authorize Hoof and Horn Art Farm & Lauren Watterson to edit, alter, copy, exhibit, publish, or distribute these photos for any lawful purpose. In addition, I waive any right to inspect or approve the finished product wherein my likeness appears. Additionally, I waive any right to royalties or other compensation arising or related to the use of the photo.
I hereby hold harmless, release, and forever discharge Hoof and Horn Art Farm & Lauren Watterson from all claims, demands, and causes of action which I, my heirs, representatives, executors, administrators, or any other persons acting on my behalf or on behalf of my estate have or may have by reason of this authorization.
I HAVE READ AND UNDERSTOOD THE ABOVE PHOTO RELEASE.
By checking the above box, the parties hereby understand and agree to all terms and conditions of this Agreement.
